Internal Complaints Committee (ICC)

Policy Statement

The College is committed to providing a safe and secure environment for women employees and students, free from sexual harassment. The Internal Complaints Committee (ICC) is constituted in accordance with the UGC Regulations, 2015 and the Sexual Harassment of Women at Workplace (Prevention, Prohibition & Redressal) Act, 2013. The ICC also addresses complaints from transgender persons to ensure inclusivity.

Objectives

  • Prevent sexual harassment through awareness and sensitization programs.
  • Prohibit any form of sexual harassment within the institution.
  • Provide a fair and timely redressal mechanism for complaints.

Scope of ICC

The Internal Complaints Committee (ICC) shall have jurisdiction over:

  • All students, employees (teaching & non-teaching), contractual staff, and visitors associated with the institution.
  • Incidents occurring:
    • On campus.
    • Off campus, if related to institutional activities (internships, field visits, study tours).
    • During official travel or events organized by the institution.
  • Complaints of sexual harassment as defined under the POSH Act, 2013 and UGC Regulations, 2015.
  • ICC does not handle non-sexual harassment complaints; such cases are referred to the Anti-Discrimination Cell or Grievance Redressal Committee.

Complaint Filing Process

Complaints can be filed within 3 months of the incident through any of the following modes:

  • Written application submitted to ICC Chairperson.
  • Email submission to dola.sinha@bcrec.ac.in.
  • Online complaint form available on the college website.

Complaint Registration and Reporting Flow (As per the UGC Regulations):

Step-1: Filing of Complaint

  • Any aggrieved woman can file a written complaint to the ICC within 3 months from the date of incident.
  • Complaint can be submitted to the Presiding Officer or any ICC member in person or head of the institution.

Step-2: Acknowledgment and Preliminary Review

  • The ICC acknowledges receipt within 7 working days.
  • The Committee conducts a preliminary assessment and informs both parties.

Step-3: Investigation

  • ICC conducts inquiry as per natural justice principles.
  • Both complainant and respondent are given an opportunity to present evidence.
  • Proceedings are recorded confidentially.

Step-4: Report Submission

  • ICC submits the inquiry report with recommendations to the Head of Institution within 90 days of complaint receipt.

Step-5: Action and Follow-Up

  • The Head of Institution acts on the recommendations within 30 days.
  • Follow-up and implementation of corrective measures are ensured.

Timelines

  • Inquiry to be completed within 90 days of receipt of complaint.
  • Action to be taken within 30 days after inquiry report submission.

Confidentiality

All proceedings and identities of parties involved shall be kept strictly confidential.

Awareness and Training

The ICC conducts mandatory orientation for new students and staff and organizes periodic sensitization workshops.

Annual Report

The ICC shall prepare and submit an annual report of cases handled and actions taken to the institution and UGC.

False Complaints

Action against false complaints will be taken only after due inquiry and proof of malicious intent, ensuring genuine complainants are not discouraged.

Display and Accessibility

Details of ICC members, policy, and complaint process are prominently displayed on the college website and notice boards.
